When we operate our businesses under the trance of scarcity, our focus is on the “not enoughness” in our world. We perceive that there is not enough time, money, perfection etc.
This is problematic because when we look at life through the lens of not having enough, we create that precise experience of lack for ourselves. This type of thinking can be likened to trying to light a flame with a dead match. You cannot set it on fire, and even if it magically did produce a flame, it would not likely burn for very long. The result is mental exhaustion and deflated self-confidence; certainly not a state where our most soulful and powerful work can be born.
Yet the most ironic thing about piling on the pressure of “right now” is this:
When we let go of the pressure to get things done now, quickly, today, tomorrow; that is exactly when things become easier and we end up getting things done that previously felt like an uphill struggle.

When it comes to determining what exactly constitutes ‘quality control’, McCarthy in his book ‘Trademark and Unfair Competition’ has observed that under the understanding of the quality theory, the consumer assumes that products sold under the same trademark will be of equal quantity regardless of the actual physical source or producer of the goods. This means, as per the expectations of the potential consumer, the legal form of ownership and control of a Trade Mark should not affect the final produced goods or service. Hence, whatever be the form of quality control exercised by the registered proprietor over the use of the Mark by the registered user, the provision of the quality control and the expectations to provide the same, must be written in an agreement (which is between the licensor and the licensee) as one of the stipulated Condit.

Copyright Movies


While buying products such as books, Music CDs, Video CDs, software etc. you must have come across the symbol © printed on them. This symbol means copyright.
What is a Copyright? 
A copyright registration essentially a set of rights granting protection to different forms of human expression of thoughts such as videos, music, books, a play etc.
Copyright is just one form of intellectual property. It is not the same as trademark, which protects brand names, mottos, logos, and other source identifiers from being used by others for certain purposes. It is also different from patent law, which protects inventions. YouTube offers a separate removal process for videos which violate trademark, trade secret, or other laws. The rights are basically to prevent another individual from reproducing or distributing, in an unauthorized manner, the product of the copyright holder’s skill and labor.
The Indian law, i.e. the Copyright Act, 1857 recognizes a ‘video’ as being entitled to copyright protection too so let us understand why at all should you obtain a copyright for a video.
Which types of work are subject to copyright?
When a person creates an original work that is fixed in a physical medium, he or she automatically owns copyright to the work. Copyright ownership gives the owner the exclusive right to use the work in certain, specific ways. Many types of works are eligible for copyright protection, including:
·        Audiovisual works, such as TV shows, movies, and online videos
·        Sound recordings and musical compositions
·        Written works, such as lectures, articles, books, and musical compositions
·        Visual works, such as paintings, posters, and advertisements
·        Video games and computer software

Limited Liability Partnership

Limited Liability Partnership is a hybrid between a company and a partnership that, as the name suggests, provides the benefits of limited liability and allows its members the flexibility of organizing their internal structure as a partnership based on a mutually arrived agreement.
The LLP law in India
Limited Liability Partnership [LLP] is viewed as an alternative corporate business vehicle that provides the benefits of the limited liability but allows its members the flexibility of organizing their internal structure as a partnership based on a mutually arrived agreement. LLP form is expected to enable entrepreneurs, professionals and enterprises providing services of any kind or engaged in scientific and technical disciplines, to form commercially efficient vehicles suited to their requirements.
With this background, Limited Liability Partnership Act, 2008 [LLP Act] was enacted on January 7, 2009.
Requirements for Forming an LLP Today, Startup companies have thronged the marketplace with the opening of the Indian economy and for any Startup, the LLP structure provides the best of both the corporate as well as partnership world. Before embarking on incorporating an LLP it is important to check whether the proposed LLP name is available with the Registrar of Companies. It is also important to obtain the Director Identification Number (DIN) and the Digital Signature for the LLP in advance. One of the basic requirements of an LLP is a minimum of two partners but there is no limit to the maximum number of partners allowed in a limited liability partnership firm. Again, the minimum two designated partners of the LLP must be individuals, of whom at least one is a resident of India. However, body corporate or organization, a foreign company, a foreign LLP can also be partners of a LLP as long as the above requirement of two designated partners is fulfilled.
LLP structure allows small and medium sized enterprises (SMEs) as well as Startups with the freedom of incorporating with bare minimum capital. There is no minimum capital contribution required from the partners and the partners can even contribute in instalments into the LLP without any limitations.
Extent and Limitation of Liability An LLP being a separate legal entity is liable for an obligation arising in contract or otherwise and the liabilities of the LLP will be met out of its property. A partner will not be held personally liable, directly or indirectly for an obligation of the LLP, solely by reason of being a partner of the LLP. However, such liability shall not affect the personal liability of a partner for his own wrongful act or omissions and in the event of an act carried out by the LLP or any of its partners, with intent to defraud creditors of the LLP or any other person, or for any fraudulent purpose, the liability of the LLP and partners who acted with intent to defraud creditors or for any fraudulent purpose shall be unlimited for all or any of the debts or other liabilities of the LLP. Therefore, a partner will be held personally liable for his own wrongful act or omission, but not for the wrongful act or omission of any other partner of the LLP.

Copyright registration



What is Copyright?
Copyright registration a right given by the law to creators of literary, dramatic, musical and artistic works and producers of cinematograph films and sound recordings. In fact, it is a bundle of rights including, inter alia, rights of reproduction, communication to the public, adaptation and translation of the work. There could be slight variations in the composition of the rights depending on the work. Copyright ensures certain minimum safeguards of the rights of authors over their creations, thereby protecting and rewarding creativity. Creativity being the keystone of progress, no civilized society can afford to ignore the basic requirement of encouraging the same. Economic and social development of a society is dependent on creativity. The protection provided by copyright to the efforts of writers, artists, designers, dramatists, musicians, architects and producers of sound recordings, cinematograph films and computer software, creates an atmosphere conducive to creativity, which induces them to create more and motivates others to create.
Objective of Copyright: The object of copyright law is to encourage authors, composers, artists and designers to create original works by rewarding them with the exclusive right for a limited period to exploit the work for monetary gain.
Does copyright apply to titles and names: Copyright does not ordinarily protect titles by themselves or names, short word combinations, slogans, short phrases, methods, plots or factual information. Copyright does not protect ideas or concepts. To get the protection of copyright a work must be original.
